Full Legal Victory at the Second Hearing (Lawsuit Against Trial Decision to Invalidate Patent)

In a lawsuit against a trial decision on patent invalidation, pertaining to the patent for the invention titled “Film Deposition Method and Film Deposition Apparatus” (Patent No. 4823293, Patent Owner: Shincron Co., Ltd.), the Intellectual Property High Court (IPHC) has thoroughly dismissed Shincron Co., Ltd.’s claim for patent validity, and has delivered a judgment to maintain the trial decision to invalidate the patent, in accordance with the claim by Optorun Co., Ltd.

As Shincron Co., Ltd. did not appeal to the Supreme Court in response to the IPHC’s decision against Shincron Co., Ltd., the “invalidity of the said patent” was settled.

In a related matter, Shincron Co., Ltd. filed a patent infringement lawsuit regarding the said patent against Optorun Co., Ltd. at the Tokyo District Court.

However, last year, the Tokyo District Court fully accepted Optorun Co., Ltd’s claim, and rejected the petition by Shincron Co., Ltd. Furthermore, this year, at the second hearing conducted at the IPHC, the court announced its decision to accept the judgment of patent non-infringement handed down by the Tokyo District Court (first hearing).

As Shincron Co., Ltd. did not appeal to the Supreme Court in response to the IPHC’s decision in favor of Optorun Co., Ltd., the IPHC’s “judgment of patent non-infringement” was settled.

According to the above decisions, both matters of 1) “the IPHC’s judgment of non-infringement of the said patent by Optorun Co., Ltd’s product” and 2) “the invalidation of the said patent” were ultimately settled.
